Please note: This is a guide to assist you. A full, comprehensive list of all specific exclusions and conditions relating to claims can be found directly within your policy wording document. All cover is subject to the policy terms, conditions, exclusions, and any applicable excess.
Q: What does the Personal Liability section cover, and what are my responsibilities?
A: This section covers payments, including legal costs and expenses, up to the amount specified in your Table of Benefits, if you become legally liable to pay compensation to a third party. This applies to a claim or series of claims resulting from a single accidental event during your trip.
1. What is Covered?
Accidental Injury or Illness: Claims for accidental injury, death, illness, or disease caused by you to any person. This person must not be in your employment, be a close relative, or reside with you.
Accidental Property Damage: Accidental loss of or damage to property that does not belong to you or a close relative, and is not in your charge or control.
Temporary Holiday Accommodation: Damage to temporary, legally rented holiday accommodation (occupied but not owned by you) is covered. However, this is strictly intended for scenarios where you are taken to court for causing substantial, major damage (e.g., a major fire or flood caused by a faulty device). Small, everyday accidental damages—such as a minor burn mark on a sofa or a blown plug socket—are not covered under this insurance, as these are typically handled by your holiday rental deposit.
💻 Rules for Remote Workers & Laptops
If you are legally subleasing or renting a holiday property for leisure and working remotely, substantial property damage caused by your personal laptop is covered. However, please note that if the property is actively rented or paid for by your employer, no coverage applies. Furthermore, work laptops and corporate gadgets themselves are never covered under this travel insurance policy; business equipment must be insured directly through your company's commercial insurance.
2. What is Strictly Not Covered?
We will refuse to cover any personal liability claims arising from:
Incidents Inside the UK: Any incident or accident that occurs within the United Kingdom is completely excluded from this section.
Vehicles, Cars, and Machinery: The ownership, possession, or use of any mechanically propelled vehicles, aircraft, or motorized watercraft. We do not offer car or rental vehicle insurance. If you hire a car, moped, or motorized machinery abroad, you must secure necessary liability insurance directly from the hire company. (Note: Manually propelled boats like surfboards, rowing boats, punts, or canoes remain covered).
Business & Trade: Any liability arising from the pursuit of your business, trade, profession, occupation, or the commercial supply of any goods or services.
Contractual Agreements: Liability you voluntarily assume under a contract or agreement, unless that legal liability would have naturally existed anyway without the contract.
Diseases and Animals: The transmission of contagious or infectious illnesses, conditions, or viruses. This section also excludes liability related to your ownership, care, custody, or control of animals.
3. Special Conditions: What You Must Do If Faced with a Claim
If you are involved in an incident that could lead to a legal claim against you, you must follow these strict procedures:
Report Instantly: You must give us written notice of any incident as soon as possible.
Do Not Negotiate: You must not admit liability, apologize, offer compensation, or enter into any legal negotiations with the third party without our express written permission.
Forward Legal Documents Immediately: You must send us every court claim form, summons, letter of claim, or legal notification the exact day you receive them.
Our Right to Take Over: We are legally entitled to take over and completely manage the defense, negotiation, or settlement of any compensation claim brought against you. We hold full discretion over these legal proceedings, and you must provide us with all necessary assistance.
Legal Representatives: If you pass away, your legal representatives or estate will continue to be protected by this coverage, provided they comply with all policy terms.
